Andrew G. Hamill

Partner

Andrew Hamill is a partner at Alberti Lim who focuses his practice on patent litigation in district courts and at the International Trade Commission, where he has achieved significant victories for plaintiffs and defendants. He has experience in all phases of patent litigation, including pre-suit analysis, arguing Markman hearings and dispositive motions, taking and defending fact and expert witness depositions, trial, and appeals. Andrew has also successfully represented his clients before the PTAB in Inter Partes Review proceedings.

Andrew has litigated highly complex cases involving a diverse array of technologies including smartphones, cable modems, VPNs, flash memory, CMOS image sensors, power amplifier designs, AMOLED displays, and communication systems. Before law school, Andrew worked in industry as a software engineer and earned a B.S. in Computer Science.

Andrew has over 18 years of IP litigation experience. Before joining Alberti Lim, Andrew started his career at a prominent international law firm. Andrew previously interned for the Hon. Susan Braden in the U.S. Court of Federal Claims.

Adaptive Spectrum and Signal Alignment, Incorporated (ASSIA) v. Charter Communications, Inc. (E.D. Texas) Alberti Lim represents ASSIA, a pioneering Wi-Fi innovator founded by a team from Stanford University (https://assia-inc.com), in an ongoing 5-patent case enforcing ASSIA’s patented technologies against one of the nation’s leading cable and Wi-Fi providers. Set for trial in the spring of 2026.

Polaris PowerLED Technologies, LLC v. Samsung Electronics Ltd. (E.D. Texas) Alberti Lim represented Polaris in a patent infringement case related to AMOLED displays, wireless charging, and LED television backlight technologies. The case settled favorably on the eve of jury trial in 2024 after defeating Samsung’s summary judgment and Daubert motions. 

Broadband iTV, Inc. v. AT&T, DirecTV, Dish Network LLC (W.D. Texas) Alberti Lim represented BBiTV, a pioneering video-on-demand and content management technology company, in three consolidated five-patent cases. The cases settled favorably in 2021 after expert discovery.

Wapp Technologies, LLC v. Micro Focus, Inc., HP Enterprises, Inc. (E.D. Tex.) Andrew helped Wapp Technologies win a $172.5 million jury verdict of willful infringement in a multi-patent case relating to mobile application development technology against Micro Focus in March 2021.

Epic Communications Inc. v. Richwave Technology Corp. (Santa Clara Superior Ct.) Represented Epic Communications in a trade secret action involving WiFi power amplifier designs. Obtained favorable settlement after overturning summary judgment on appeal.

Govino LLC v. Goverre Inc. (C.D. Cal.) Represented wine glass maker in trademark infringement action. Case settled favorably on the eve of trial after defeating the defendant’s summary judgment and Daubert motions.

Confidential Arbitration (AAA) Represented former employees of stealth mode battery startup in trade secret action relating to solid state battery technology. Case settled favorably prior to arbitration hearing.

Asustek Computer Inc. v. Round Rock Research LLC (N.D. Cal.) Represented Round Rock Research in action involving memory flash memory and CMOS sensor technology. Case settled favorably after expert discovery.

VirnetX v. Cisco et al. (E.D. Tex.) Represented Cisco in action brought by VirnetX relating to VPN technology. Case resulted in jury verdict of non-infringement.

Motorola et al. v. Rembrandt (D. Del.) Represented Cisco, Motorola, Netgear Ambit, Thomson, and Scientific-Atlanta in a declaratory judgment action against Rembrandt relating to the DOCSIS standard for Internet over cable. Rembrandt signed a covenant-not-to-sue after the parties exchanged expert reports. The court subsequently awarded over $50 million in attorneys’ fees under 35 U.S.C. § 285.
